Comparative Study on Principles of Good Faith and Fair Dealing in Contract Laws of the United States of America and Bhutan

Bhutan, a small Himalayan nation is built and stands on values of honesty, fairness and harmony. Yet, the legal system, still have not recognized and applied the principles of good faith and fair dealing in contract disputes in Bhutan. Courts in Bhutan should apply these principles not only as matter of law and justice but also for the furtherance of trust, honesty and fairness in the country. The United States have time tested application of good faith and fair dealing in all forms of contracts developed over centuries. The adoption of U.S. experience as a model for Bhutan is presumably, best alternative for the Bhutanese courts to begin the application of good faith and fair dealing in contract disputes in Bhutan.
