Bribery as a Barrier: Fighting Bribery through the World Trade Organization

Bribery is prevalent in international trade: not only are there many opportunities for bribes in international trade, but it is clear that bribery frequently happens at many stages of an international trade transaction. Bribery's influence on international trade is detrimental, and despite this fact, nothing in the rules and agreements of the world's international trade body--the World Trade Organization (WTO)--directly addresses it. However, there are solutions--both available now and potentially in the future--for fighting this trade barrier through WTO law. This thesis analyzes these solutions and argues that WTO countries whose companies are negatively impacted by bribery in international trade should use these mechanisms to combat bribery and, in so doing, encourage the free exchange of goods and services among the WTO's Member countries.
