Implementing modular open systems approaches (MOSA) in Department of Defense (DoD) acquisition programs to reduce sustainment costs and improve technology refresh and innovation is not just a technological and business imperative. MOSA is a national security priority. This thesis discusses the many aspects of MOSA, from the business incentives to the legal issues of making MOSA a reality in the DoD. One significant obstacle to DoD programs’ implementation of MOSA is the lack of evaluation criteria for assessing program effectiveness. Evaluation criteria will assist DoD in understanding what programs need assistance. The DoD IP Cadre can assist with developing these criteria and Congress should amend MOSA legislation assigning the IP Cadre responsibility for creating evaluation criteria that measures a program’s effectiveness at procuring IP and implementing MOSA. Congress could also direct DoD to establish a pilot program reviewing a select number of large, medium, and small acquisition programs by the IP Cadre. The pilot program will illuminate opportunities for IP Cadre assistance, which will lead to improvement in the programs that need it the most. This path forward is more about performance than about compliance, and information collected and distributed should not be viewed as mere homework for a report card. There exists both opportunity and necessity for improving DoD’s acquisition of IP licenses and the implementation of MOSA. Great opportunities can be seized as the DoD modernizes its forces. There is a necessity to do so, and failure can negatively affect U.S. national security. By implementing a reasonable evaluation of DoD’s acquisition programs, DoD’s IP Cadre can understand where opportunities to improve exist and take steps to offer needed assistance to programs with the most to gain.
